1. Membership Application and Payments

1.1 Membership Eligibility

• A. Nature of Business in the Trade License must be Buying House.
• B. Buying House shall not be engaged in import of Garments or import in the style of “Samples” for selling or to open shop or selling Garments either in wholesale or retail in the Bangladesh Market. The Nature of Business of a Buying House company is to be involved in the field of Marketing of Readymade Garments, receiving authenticated export L/C or Sales Contracts, and executing through Readymade Garments industry(s) or factory situated in Bangladesh, or exporting abroad from Bangladesh.
• C. Owner of the Buying House (Proprietor/Partner/ any of Board of Director) must not be involved in direct or indirect employment with any other company having the same business nature. If the owner is involved with another BGBA registered Buying House, they must submit a No Objection Certificate (N.O.C) from the Member company.
• D. The newly applied company name must not be the same or similar to another company’s name or logo in Bangladesh or abroad.
• E. The Buying House must not be involved in the production of Fabrics/Accessories/Packaging or supply in Bangladesh or abroad.
• F. The Buying House must operate within a standard sizeable space and must not operate in the manner of a home cum office or office cum home, or in the manner of a shop in a shopping market or shopping mall.
• G. The described office (Mailing Address) must be operated by the Buying House Owner and must be available for inspection by BGBA/Department of Textiles. Buying House must notify BGBA/Department of Textiles once they decide to vacate this office.

1.2 Application Submission

• A. Information provided by new applicants in submitted documents to obtain membership of the Bangladesh Garment Buying House Association (BGBA) must be genuine and true. In case of any breach or false information, membership will be suspended, blacklisted, or ceased without any refund.
• B. BGBA reserves the right to accept or reject any application based on a physical inspection of the Mailing Address or for any other valid reason. Additional documents, verification, or physical interviews may be required.

1.3 Membership Fees

• Membership fees and any related charges must be paid in full at the time of application. Payments can be made securely through our online payment system. Information provided by new applicants must be genuine and true. In case of any breach or false information, membership will be suspended, blacklisted, or ceased without any refund.

2. Privacy Policy

• 2.1 Collection of Information: We collect personal information from members and applicants to process membership applications and payments. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.
• 2.2 Use of Information: Your personal information will only be used for the purposes stated in our Privacy Policy, including membership processing, communication, and compliance with legal obligations.

3. Return and Refund Policy

• 3.1 Non-Refundable Fees: Membership fees and payments made through our platform are NON-REFUNDABLE, except as provided in clause 3.2.
• 3.2 Refunds: In the event of a billing error, refunds will be processed within 7 to 10 working days from the date of request. Refunds will be issued to the original method of payment.

4. User Responsibilities

• 4.1 Accurate Information: Information provided by new applicants must be genuine and true. Any breach or false information will result in suspension, blacklisting, or ceasing of the membership without any refund.
• 4.2 Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Limitation of Liability

• 5.1 Disclaimer: BGBA makes every effort to ensure the accuracy and reliability of the information provided on this Site. However, we do not guarantee the completeness, accuracy, or reliability of any information or content.
• 5.2 Limitation of Liability: To the fullest extent permitted by law, BGBA shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Site or any content therein.

6. Governing Law

• 6.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

7. Changes to Terms

• 7.1 Modification: BGBA reserves the right to modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
